These Terms of Service (“Terms”) govern your access to and use of OnTheTron(“OnTheTron,” “we,” “us,” or “our”), a project operated by ActualCoolThings, including the website at onthetron.com and related services (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Service, you represent that you meet these requirements.
2. The Service
OnTheTron lets you upload a photo and uses artificial intelligence to generate a short, stadium-themed “jumbotron” video featuring your likeness, which we deliver to you by text message. The Service is currently provided free of charge. We may add, change, or remove features at any time.
3. Your content and the license you grant us
“Your Content” means the photos and any other material you submit. You retain ownership of Your Content. By submitting it, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, modify, and use Your Content solely to operate and provide the Service to you — including sending it to our AI provider to generate your video.
You represent and warrant that:
- You own or have all rights necessary to submit Your Content;
- You are the person depicted, or you have the explicit permission of every identifiable person in the photo to create and share an AI-generated video of them;
- Your Content does not infringe anyone's rights or violate any law or these Terms.
4. AI-generated output
Videos created through the Service are AI-generated entertainment. They are fictional depictions and are not real broadcast footage, endorsements, or records of any real event, team, league, or venue. Subject to your compliance with these Terms, you may use the videos you create for personal, non-commercial purposes, including sharing them on social media. For any commercial use, please contact us first. AI output may be imperfect or unexpected; it is provided on an “as-is” basis.
5. Acceptable use
You agree not to use the Service to:
- Upload a photo of another person without their explicit consent, or a photo of a minor other than with verifiable parental/guardian consent;
- Create content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that depicts violence or harm;
- Impersonate any person or entity, or misrepresent an AI-generated video as real;
- Infringe the intellectual property, privacy, or publicity rights of others;
- Attempt to disrupt, overload, reverse engineer, scrape, or gain unauthorized access to the Service or its systems;
- Use the Service for any unlawful, fraudulent, or abusive purpose.
We may remove content, limit usage, or suspend or terminate access for any violation of these Terms.
6. Text messages
By providing your phone number, you consent to receive text messages from us about your video. Message and data rates may apply. You can opt out at any time by replying STOP. See our Privacy Policy for more on how we handle your number.
7. Our intellectual property
The Service, including its design, software, text, graphics, and the OnTheTron and ActualCoolThings names and logos, is owned by us or our licensors and protected by intellectual-property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights. You may not copy, modify, or create derivative works of the Service without our permission.
8. Third-party services
The Service relies on and links to third-party services (for example, our AI, hosting, messaging, analytics, and advertising providers). We are not responsible for the content, policies, or practices of third parties. Your use of those services may be governed by their own terms.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED VIDEOS WILL MEET YOUR EXPECTATIONS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OnTheTron AND ActualCoolThings WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold harmless OnTheTron, ActualCoolThings, and our affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of others.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including content licenses you've granted, disclaimers, limitations of liability, and indemnification) will survive.
13. Changes to the Service and these Terms
We may modify the Service or these Terms at any time. When we change these Terms, we will update the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which the operator is established, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved on an individual basis, and you waive any right to participate in a class action to the extent permitted by law. Nothing in these Terms limits any rights you may have that cannot be waived under applicable law.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
